Why would a journalist seek refuge and retribution from the laws of the land?

This is in response to a blog by Mr. Vir Sanghvi in Hindustan Times date July 27th 2010. "Defamations and redressals"

Mr. Sanghvi. Is unnerved, the overwhelming negative response that he receives on most occasions. This blog is the outcome of that, he wants retributions, however cannot term most negative comments as defamatory.

There are two aspects to this blog.

1. The essence or the soul. The deep seated part!

2. The printed word or the body. The superficial part!

It would be convenient to focus on the printed part express myself and move on, but that would not really do justice to what the author is attempting to say. So let us begin by addressing the first part, the essence and soul.

Mr. Sanghvi is feeling vulnerable and is unable to state so in clear terms. The monopoly of taking potshots at others over a long period of time emboldened him, he graduated to ambushes, and later to mounting all out attacks on anyone that he wished, or as commissioned by the political paymaster. A fair number of journalists made common cause and banded together into groups as Mercenaries. Their services were available to a select group willing to pay the demanded price. All this was being done from a very secure and impregnable fortress. The targeted individual was unable to strike back ; protest letter s to the Editor were summarily dismissed for want of evidence or on the basis of Freedom of Speech and Expression and at times as Journalistic creative composition. Appearance on Electronic media utterance and disparaging remarks made on other went unchallenged due to common reasons.

Spread of net and advent of Blogs now enable the aggrieved party to rebut often level counter allegations. Blogging has enabled the independent objective observer to register his protest! The game plan is all too apparent, he has jumped into the fray to correct the imbalance which individuals like Vir Sanghvi enjoyed previously.

Moderators were introduced on the web sites and Blogs ostensibly to filter offensive and objectionable post, the real purpose was to control contrarian views. Initially the positive posts were extensively used as testimonials; which was good for the business, over a period of time negative reactions from the public increased manifold, though successfully kept at bay on his web site or his Blog; has failed to instill that sense of security and immunity which was originally there. When the negative reactions are higher the payments will not be made since the desired results have not been achieved. The paymasters do not tolerate failures and this would lead to redundancy.

We thought we were up against a man who had it in him to take as good as he gave, unfortunately the turning of the tide has made him to scream in a very loud voice Defamation, Redressal and demands retribution.

Now incase these comments do not appear on this blog I am free to publish this on any site which offer free blog services. The reach of net + blog should not be subject to censorship.

Require a Large Domestic Constituency for Peace with Pakistan

This is in response to Peace cannot be built on Pak’s lies in the Hindustan Times Dated July 31st 2010.

The subject of India-Pakistan relationship cannot be addressed in piecemeal or fragmented manner. We are dealing with a hostile neighbor whose raison d’être is our destruction. We must review this subject keeping in mind the complete history of last 63 years. It bears testimony to our complete lack of policy towards this nation, we more often than not suffer cerebral seizure; Two events standout where we could have resolved the outstanding issues conclusively with Pakistan.

1. 1971 when we held more than 90,000 Prisoners of War.

2. 1999 Bus ride to Lahore by Mr. Vajpayee.

Unfortunately documents pertaining to 1971 need to be de-classified before a final judgment can be passed on what went wrong and why we missed that opportunity? 1999 is something which unfolded before our eyes, is comparatively recent, betrayal or should one say the reciprocal action from Pakistan of foisting Kargil on us has scarred our psyche to a great extent. Public hostility was limited even after this, since our well trained and capable Men in Uniform reclaimed the areas that were surreptitiously occupied by infiltrators from Pakistan.

Attack on Parliament, mobilization of troops a long stand off, followed by bomb blasts on a regular basis across India, routine statements of condemnation, usual suspects we accepted from the authorities in India, were treated with the skepticism that they deserved. The scope for improving relations with Pakistan was still very highly and the public support was there for this exercise.

Post 26/11 all this has changed decisively. The phantom of numerous bomb blasts, were visible in flesh and blood to all in India and overseas for the first time and over a period of nearly 72hours when not just Mumbai, the whole country was held hostage. Denials of Pakistan have been blown away with a firm finality. Relations with Pakistan will be bench marked henceforth with the severity of punishment, the time taken by that country to punish the culprits in its custody, as also those who remain free.

Disconnect between the people and UPA Government headed by Congress is self inflicted, this is not restricted to just the educated class. Congress took a very strident stance towards Pakistan and Terror during the general elections 2009, tough on terror and no dialogue without cession of terror from Pakistan, coercive diplomacy, paid due dividends and ensured victory at the hustings, yet it also engendered an extremely rigid public opinion, absence of retribution has further hardened the sentiments of the Indian public.
The other faux pas committed by the Government of Indian are.

1. Alacrity displayed for acceptance of Non State Actors nomenclature for the participants of 26/11.

2. Joint Terror mechanism.

3. Victim of terror tag for Pakistan is the result of generosity from our UPA Government.

4. Fiasco at Sharm-el-Shaik.

5. Introduction of Baluchistan.

6. Dialogue only way forward.

7. The latest discourse of inability to attain great power status due to hostile relationship with a small nation.

The above stated reasons are sufficient for sustaining the disconnect between the people and the Government of India.

Wikileaks have not come as a surprise to us, have we not been shouting this ad nauseum, at best it reveals the murky dealing of USA and Pakistan in Afghanistan. The latest incident in Islamabad cannot be pushed aside by either pointing a finger at Pakistan or at Mr. G.K. Pillai, this exercise in futility should never have been initiated.
UPA government has not till date come up with any confident and complete response as to what they hope to achieve thru these dialogues with Pakistan.

Terror cannot be contained by a dialogue process. Great Power status cannot be held hostage to relationship with a neighbor, it flies in the face of logic, our progress so far has not been because of assistance rendered by Pakistan. The umbilical cord was cut in 1947 or as your colleague in HT says we were “Separated at Birth” Great Power status is not defined solely in terms of economic growth, there is Military might which contributes significantly, the ability and will to exercise this might judiciously, finally the political will to propagate and view all relations thru the prism of Supreme National interest.

Improving relations with Pakistan will have to wait; in the meantime we will need to devise a comprehensive policy for this. Unfortunately this cannot come from the serving bureaucrats as most are subservient to the governing dispensation. The Political class in our perception is not equipped to formulate the foreign policy given the levels of education that they have. We need a group of individual well versed in foreign relations they could be superannuated diplomats who somehow seem to find their voice once free of the Government control to name a few Mr. Kanwar Sibal, Mr.K.C Singh, Mr.G. Parthasarthy and Mr. Lalit Manshing. In conjunction with defence analysts like Mr. Raja Mohan, Mr. Bramha Chellany, Mr. Maruf Raza and a few retired Generals and High Rank officers from Indian Air Force and Navy could come up with a policy document which could be implemented by this government, foreign policy is a continuous process and not something that can be changed by the future Governments, they may change tack or focus the substance cannot change.

Finally the domestic political discourse also must be moderated; the shrillness, the viciousness and the Secular Vs Communal debate must end for it does not contribute to our unity at all. To become a great power we require Rule of Law, higher level rating on Human development indices, eradicate corruption, education, health and infrastructure. GDP growth alone will not be the correct measure of Great Power we have 500 million Indians whose status is below the poorest of the poor on the African continent.

Entry to Parliament and Primer Minster’s post is possible sans popular support; peace with Pakistan would require that ingredient in a very wholesome measure. Hoping for a pragmatic rather, than a dogmatic approach from the UPA and its media brigade!

India Pakistan chasing a Mirage of Peace

This is a rejoinder to -  Khakis over civvies  Hindustan Times dated 24th July 2010 Author Ms.Barkha Dutt.

Thank you Hindustan Times for zealously protecting our right of expression as you do yours. Most of us come to this site for there is no censorship unlike most other mainstream English media sites, here comments are flagged only if they are offensive in the extreme.

There are three types of species that populate HT.

The first is Indians like me who have a fair command of the language, and an opinion on almost every issue. Yes we are also referred to as the Net Terrorists or the Khaki chuddy brigade because we do not subscribe to the views of a certain sect of people. The second are the ones who have pretensions to being journalists, often declaring awards at the end of every year for a political party and collecting Padma awards as return gifts, though the burning desire is to be nominated to the August House the Rajya Sabha. The author of this piece and of course the other is, the venerated Rajdeep Sardesai of CNNIBN. The third and last specie is the pseudo secularists who are more rabid than the oft labeled communalists, names are well known to all.

The order of priority used is a clear give away. “The truth is that as Prime Minister Manmohan Singh steers his brave vision for peace through a minefield of obstacles — terror threats, inflammable public opinion, a sceptical party cadre and the shadow of 26/11” Under pressure from USA the UPA government seems to be ready to put 26/11 in deep freeze, and render lip service to this fact. The inflammable public opinion is on account of 26/11 and nothing else.

This author is a leading member of the bleeding hearts brigade.

There is a marked shift in the thinking of the author, I recall that soon after Musharraf had demitted office, a democratically elected Government in Pakistan was in place, this author was a very vocal proponent “That India had a duty to strengthen Democracy in Pakistan” to which my response was that it was not just a foolish proposition but bordered on lunacy that India be the party bearing the cross and shouldering the responsibility of something that must logically rest with the people of Pakistan.

The other significant point that the Author has raised is let us ape USA , speak with the men in Khaki in Pakistan. Since the author is often seen to take the UPA government line, there is a sneaking impression, this formulation is being stated on the basis of some information that she may be privy to. The question that needs to be addressed in this regard is. How is this objective going to be achieved? Out source the process to Uncle Sam to point the noses of these commandos towards the table and issue instructions start chattering. India cannot ape USA simply since we are not the US of A, nor do we have the muscle to implement this on our own. Just for a moment let us assume that we do somehow manage to sit across the table, who is going to do the talking? NSA , NAC or our politicians who are preoccupied with ingratiating themselves before their high command, dipping into the till with both their hands, consolidating vote banks or ensuring comfortable futures for their heir, and time permitting attending to the requirements of the Nation. The only possible party that is capable of engaging the generals from Pakistan, are the men in uniform from our side, need the results of such a meeting be stated, one party’s raison d’être is avenge 1971 and bleed India through 1000 cuts, the other is there to prevent that eventuality.

Let us do away with the joint press conference is the next pearl of wisdom from this author, ignoring the fact Agra ambush happened because our over hyper media did not recognize the commando in civvies, India was not mauled, the obvious did not happen. Sharm-el-Shiekh and now Islamabad we have come away with a bloodied nose. Tail firmly tucked between our legs, playing favorites between MEA and HM the tilt seems to be towards the MEA as the benefit of doubt is being extended that “probably the details were not shared with MEA”. The divide is deeper than we think.
What will we gain? And what do we hope achieve? Are the two questions which need a firm and confident reply from the UPA Government!

In conclusion the K song has become putrid having been played for past 63 years, should be canned without much ado, replace it with POK, pay no royalty for it even when played by the other party. Focus on containing and eliminating the 1000 cut policy, by raising the costs for the employer. Make it uneconomical and unviable by a robust and firm response. Time to flex our muscles, negotiations and peace will follow.

Opaque Operations!!!!

The period 18th April 2010 to 30th April 2010 has been a particularly significant period for us. The chronological order of the events unfolded before us.

1. Resignation of Mr. Shashi Tharoor. (IPL fallout)
2. Suspension of Lalit Modi (IPL fallout)
3. Arrest of Ketan Desai of Medical council of India.
4. Arrest of 2 senior bureaucrats on charges of corruption. (MHA)
5. Mayawati supporting the UPA Government in Parliament subsequently the Cut Motion defeated in Parliament.
6. Conclusion of the trial of lone surviving terrorist of 26/11/2008
7. Telecom spectrum scam. (2G)
8. Telephone Tapping of Politicians.
9. Ms.Madhuri Gupta.

Which of these should have taken precedence for an article by any journalist, largely depends on his/her leaning and compulsions as dictated by the Political masters of that particular media house.

It comes as no surprise to read Opaque Operations by Ms. Barkha Dutt her political proximity and preferences are well known to all of us. The choice of subject is along the expected lines, for it is her favorite which in line of fire, had it been any other political setup besieged with similar issues she would have gone to town with her ranting and denouncements of that outfit.

Modi is to journalists, as the proverbial red rag is to bulls, regardless of the fact this time it is Lalit and not Narendra. The writer is castigating Indians for their obsession to show case India thru the sprawling acre of Infosys rather than the Dharavis of India. Dharavis are the creative formulations of our political class, and Infosys the outcome of entrepreneurial skills and hard work of the middle class people of India. Yes the Indian of today seeks idols in the corporate world, for this is one enduring dream that all Indians have and seek to realize. It is not a fantasy that Modi created, sold to the people of India and the world at large. IPL is a great product created by an imaginative individual with copious amount of blood sweat and tears as the cliché goes. The author believes that celebrating Indians on the international billionaires list is a shallow validation.

Has his life really spun out of control? Subject for a larger debate! Only the envious would pretend to look the other way, for the students and the business people of India here is a model to be studied and replicated. The whispers of sleaze funds and tax evasions need to be investigated and proved in the court of law. To categories IPL as a fantasy reeks of biased mindset.

There is a sweeping and a generalized statement being made, there is no denying that good bad and ugly exist in every walk of life. This is not reason enough for us to paint all business people with the same brush. In comparison to what we have on the political canvass, corporate India would need to really work hard to achieve a similar dubious reputation. This is what would be classified as a fantasy, in the business world it is about actual responsibility as against the imagined moral responsibility in the political field.
Corporate India has accountability and governance parameters to follow, deviation leads to serious consequences for the directors entrusted with functioning of the business on a daily basis. This is totally absent in the political arena. Vigilant media is a fallacy, what we have is a vigilante media, functioning at the behest of its political masters and for it own benefits. Media also is covered under the ambit of corporate India.

The initial 30 years of Independent India from 1947 to 1977. Which should have been the period of building this country were spent by the Congress party in injecting corruption into the system. Building behemoths which bleed steadily and continuously bringing the country to bankruptcy in ‘90’s. Can we deny the fact that it is this party which has let down the country thru its flawed policies, which made the very word businessman to denote a dishonest anti national, and profit a profanity that we were instructed never to employ. A faulty foundation is the real reason for all that ails India today.

Business is beyond the comprehension of the Jholawalas. Masquerading as a journalist is simpler, no real qualifications are required, just have the fingers on the right buttons and utter the words, the powers that maybe want hear and any Tom Dick or Harry can be labeled as a journalist. The corrupt business people will face the wrath of the law, and will serve their time as awarded by the courts. Politicians in this country have always cocked a snook at us, and walked away merrily with the entire loot. Oh how we wish the politician was answerable to us the electorate! The political class is it own master and beyond the reach of us Indians. Was this not amply borne out by the cut motion moved by the opposition in the parliament. The very parties who were holding rallies and protests outside the Parliament did not vote for the cuts so badly needed by the Indians whose back is all but broken under the unbearable weight of price rise.

Show us a single politician who has been convicted for corruption in the last 62years, no not one has paid for his crime till date.

Will the English Media yield to public pressure?

Mr.Mehta, is hallucinating Mr.Modi hates media, here we go again cause and effect Newton’s law is being forwarded by Mr. Vinod Mehta, No; this is not the correct reading of what Mr.Mehta is saying? There is a genuine complaint that Mr.Modi has not engaged or has been drawn into a slugfest with the media. Why should he? Does he have any chinks that need to be covered, have not been able to detect, he is not run of the mill corrupt inefficient yet another Chief Minister in India, who needs the media. Words are needed where action is weak or fails. Request Mr.Mehta for once to speak as a common Indian citizen without the accompanying halo of a journalist, which is the worst abuse today in India. The only perspective that individuals masquerading as journalists have is free drinks and food.

It is the guilt conscience that makes the offender perceive that he is wanted by the law, all the misplaced perception that you have, ostensibly which Mr.Modi exhibits towards the media are a manifestation of your conscience. Is it not a fact that as head of Gujarat state he must be impartial and also seen to be so, can we with any degree of conviction say the same for our mainstream English Media. The past 8 years it is the media which has been providing us with our daily fix of venomous diatribe which would put the deadliest Cobra, Viper and even the Boa constrictor to shame.

The decoding we take it at face value since it is coming from a very senior “Journalist”

02nd of April 2010 is indeed a watershed day for India not just the Congress, many in the print and electronic media have issued confessional statement on voluntary basis. Thank you we have noted the contents and the trend continues. Media is frustrated with its inability to carry out the execution after having condemned him in the Kangaroo court establish by Congress.

“Whether Modi was or was not the mastermind of the “genocide”,
“mass murder”, “carnage” has, in a sense, become a side-issue. What we have on display is a catch-me-if-you-can game and Byzantine legalese. Even after his 10-hour questioning by the SIT, he appears only marginally disadvantaged. Let me quickly add that I am totally with the sainted Teesta Setalvad, Rajdeep Sardesai, Arnab Goswami (although I am not entirely sure which side he is on!), Barkha Dutt and Siddharth Varadarajan, but at this moment Mr Modi seems to have the better of the hacks.”

Is this the confirmation that it is all about politics; the quest for justice is a convenient smoke screen. The idiom of US vs THEM being played out in full public glare with blatant disregards for professional ethics, the head must be delivered on a platter to the paymasters.

Permit me as a mango man (Aam Adami) of this country to state that we refuse to be converted into brain dead zombies. Which the individuals named by you have been attempting for the past 8 years. Alcoholics can seek refuge and assistance of the alcoholic anonymous. Unfortunately we have not been able to establish a separate institution for Modi fixated addicts.

The convoluted statements and eye witness accounts are just about beginning to unravel under their own weight; this is one such link

http://indiatoday.in…ghts.html?complete=1

your covert admiration for Modi may soon translate into a very overt act. The affect of 2 blogs and placing in public domain, the speech of Feb 2002 in the Gujarat Assembly, along with the appeals for calm made on doordarshan seem to have had the desired effect in 2010 if not in 2002. Has the Lion begun to roar again? Shall wait to see who is the last man standing in this sordid saga?

Finally if justice is what you seek, which is doubtful, then we would need to be convinced of your impartiality, the 26years long marathon being run to avoid the clutchs of law by Sajjan Kumar, Jagdish Tytler and Congress party must receive the undiluted attention that has been pointedly avoided by your saints and evangelists.
